INTERNATIONAL PROTECTION No. 6458.
People who have had to flee their country due to war or persecution and are unable to return have the right to seek asylum in Türkiye. For this, people must apply to the General Directorate of Migration Management (DGMM) and apply for asylum. The name of this application is called “international protection” application. Transactions regarding asylum seekers are carried out within the scope of the Law on Foreigners and International Protection No. 6458.
Based on the 6458 Law on Foreigners and International Protection (YUKK), the State of Turkey offers 3 different international protection status in accordance with the geographical restriction principle introduced by the 1951 Geneva Convention;
1. Refugee 2. Conditional Refugee 3. Protection
Individual Interview by Provincial Directorate of Migration Management:
It is an individual interview to get information about the reasons for the asylum seeker to flee his country and why he is afraid to return. After this meeting, which will be held with an interpreter if necessary, DGMM will decide whether the person meets the criteria to benefit from international protection in Turkey. If the official procedure is completed and the request is accepted, one of the 3 types of individual international protection status is given. These are “refugee”, “conditional refugee”, “secondary protection” status. If it is concluded that it does not meet the criteria for benefiting from international protection, a negative decision will be made about the request. You have the right to appeal this decision.
The application for international protection should be made by the applicant herself/himself, the related petition should be submitted to the governorships or directly to immigration administration.
